Qu'est-ce qu'une dette en droit ? Un constat peut être établi : des disciplines telles que la philosophie, l'économie ou encore l'anthropologie parviennent à cerner la notion de dette alors qu'en droit, on ne s'y essaye pas. La dette n'est perçue que comme l'envers de la créance ou réduite à une obligation monétaire. La présente thèse se propose de rechercher des critères de définition juridique de la dette en intégrant, en droit, les enseignements extra juridiques. La dette est ainsi détachée de la notion d'obligation, ce qui permet d'en établir un régime juridique spécifique.
