L'espace Ohada constitue aujourd'hui un pôle de développement et d'attractivité économique. La connaissance du droit des sociétés Ohada est donc indispensable à tous ceux qui exercent leurs activités sur le continent africain ou en relation avec l'Afrique. L'Acte uniforme sur les sociétés commerciales et le groupement d'intérêt économique a été réformé en janvier 2014. Sur le plan structurel, cette réforme a répondu aux besoins de la pratique en créant, à côté des formes de sociétés déjà connues, la SAS et la société à capital variable et en reconnaissant la validité des pactes d'actionnaires, ainsi que des bureaux de représentation. Sur un plan plus fonctionnel, le droit des sociétés Ohada a intégré les nouvelles technologies de la communication en permettant le recours à la visioconférence ou par d'autres moyens de télécommunication. Ce nouveau droit des sociétés, plus moderne et attractif, devrait contribuer au dynamisme des économies des Etats africains membres de l'Ohada, en suscitant davantage d'investissements nationaux et étrangers.
