Cette recherche utilise le droit administratif français comme clef de compréhension du droit des investissements. Elle compare ces deux droits en matière de contrats publics en mesurant leurs traits communs, leurs éventuelles influences réciproques et leurs points de contact. Observé depuis l'ordre juridique interne, l'arbitrage d'investissements constitue un mécanisme de contrôle juridictionnel de la puissance publique dans la globalisation. Son incidence sur les contrats publics n'avait pas été examinée de manière approfondie jusqu'alors. A la frontière entre le droit public interne et le droit international public comme privé, cet ouvrage analyse les sentences portant sur des litiges en matière de contrats publics en tant que discours sur l'Etat contractant dans la globalisation. La thèse met alors en lumière la façon dont les arbitres, à force de juger l'Etat contractant, ont construit un droit public original au-delà de l'Etat.
