La diversité des ordres juridiques, ainsi que leur multiplication, ont engendré un besoin croissant d'articulation entre eux. Les seuls mécanismes de coordination (règles de conflit de juridictions, connexité ou encore litispendance) ne suffisent plus à organiser leurs rapports et s'accompagnent désormais de méthodes d'interaction plus active, durant l'instance et à l'issue de l'instance, formant un tout qu'est le phénomène de la coopération judiciaire. Derrière l'analyse et les propositions ponctuelles d'amélioration des diverses méthodes de coopération employées par les ordres juridiques étatiques entre eux (commission rogatoire, notification des actes de procès à l'étranger, extradition, reconnaissance et exécution des jugements étrangers), et dans leurs relations avec l'ordre arbitral (aide du juge d'appui, reconnaissance et exécution des sentences arbitrales), ainsi qu'au sein de l'ordre européen mû par le principe de reconnaissance mutuelle (mandat d'arrêt européen, reconnaissance des décisions civiles et pénales, décision d'enquête européenne, communication des actes de procédure, recherche de preuves dans l'espace judiciaire européen), l'étude révèle une unité profonde de la notion de coopération. D'abord dans ses critères, dans la mesure où celle-ci s'analyse en un acte de procédure, accompli librement par un juge, à la demande d'un ordre juridique tiers pour les besoins d'une procédure présentant un élément d'extranéité. Ensuite dans son fondement, lequel réside dans la réciprocité des rapports entre les ordres juridiques, ainsi que dans sa finalité, elle-même unique, bien qu'elle se décline différemment pour l'ordre juridique requérant et l'ordre juridique requis. Pour l'ordre juridique requérant, la finalité est assez évidente : il s'agit de parfaire l'office auquel le juge est tenu. Mais quelle est la finalité pour le juge requis lorsqu'il accepte de coopérer ? La coopération apparaît pour lui comme un moyen de contribuer à une meilleure administration de la justice transfrontalière. L'étude révèle finalement que la coopération judiciaire aboutit à transformer l'office du juge. Il ne se réduit plus à trancher un litige au sein de son ordre juridique, mais comprend aussi un office coopératif permettant à un autre juge de dépasser l'extranéité dans l'instance et contribuant à une meilleure administration de la justice d'un autre ordre juridique.
