Cet ouvrage est le premier tome de l'Introduction générale, refondue dans cette cinquième édition par Jacques Ghestin, professeur émérite de l'Université Paris 1 (Panthéon-Sorbonne) et Hugo Barbier, professeur à l'Université d'Aix-Marseille, avec le concours de Jean-Sylvestre Bergé, professeur à l'Université Jean Moulin Lyon 3, membre de l'Institut universitaire de France. La précédente édition, parue en 1994, avait été rédigée par Jacques Ghestin et Gilles Goubeaux, avec le concours de Muriel Fabre-Magnan. L'ouvrage expose, d'un point de vue théorique et pratique, les notions introductives essentielles à l'étude du droit civil tel qu'il est aujourd'hui. Il présente une analyse approfondie de la doctrine et du droit positif, notamment de la jurisprudence de la Cour de cassation, du Conseil d'Etat et du Conseil constitutionnel, ainsi que des principales juridictions européennes et internationales. Il s'adresse aux étudiants de licence et de master, aux universitaires et aux professionnels. Cette nouvelle édition est divisée en deux tomes. Le premier tome comporte une première partie sur le droit objectif et les droits subjectifs et une seconde partie, relative aux sources du droit. Outre une refonte des développements présents dans les précédentes éditions, l'ouvrage contient des développements nouveaux : en particulier, une tentative de définition de la norme juridique une analyse approfondie des grandes évolutions des sources du droit, notamment leur européanisation et leur internationalisation une étude du droit souple une présentation détaillée de la question prioritaire de constitutionnalité et une étude de la normativité des arrêts rendus par la Cour de cassation. Le second tome, à paraître, sera relatif à la mise en oeuvre des droits. Il traitera, notamment, du droit de la preuve, ainsi que des mécanismes de contrôle, en particulier les théories de la fraude, l'abus et la bonne foi. Jacques Ghestin est professeur émérite de l'Université Paris 1 Panthéon-Sorbonne. Hugo Barbier est professeur à l'Université d'Aix-Marseille. Jean-Sylvestre Bergé est professeur à l'Université Jean Moulin Lyon 3.
