Description
La deuxième édition de ce volume consacré aux contrats d'assurance est le troisième volume du Traité de Droit des assurances, sous la direction de Jean Bigot. Le tome I est dédié aux entreprises et organismes d'assurance, le tome II à l'intermédiation en assurance et le tome IV est relatif aux assurances de personnes. Le tome V est consacré aux assurances de dommages. Cette nouvelle édition, entièrement réécrite, a été complétée par une nouvelle partie relative à la mise en place et à l'exécution du contrat d'assurance administratif, qui succède utilement à celle consacrée au contrat d'assurance de droit privé. Fruit de la loi Murcef, le contrat d'assurance administratif est une innovation importante, où s'opposent parfois les règles du droit privé et du droit public. L'ouvrage intègre également la loi relative à la consommation, dite loi Hamon, du 17 mars 2014. Cette loi comprend plusieurs dispositions intéressant le droit des assurances, parmi lesquelles la faculté de renonciation en cas de cumul d'assurances et la résiliation infra-annuelle des contrats tacitement reconductibles.
