The treatment of pensions on divorce has become a hot topic in family law circles in recent years. The publication of the Pension Advisory Group’s report and recent case law has caused family lawyers to take a greater interest in pension assets than before. Alongside this, the increasing number of negligence claims being brought against solicitors as a result of incorrect advice in relation to pensions gives lawyers an even greater reason to ensure that they are familiar with these complex assets, and how the court treats them on divorce. 20 years on from the introduction of pension sharing orders, family lawyers are now realising that the ‘add it all up and divide it in half’ approach is not necessarily correct. This book aims to address how lawyers should treat a pension asset, what advice they should give their clients and what a court is now likely to do when it comes to dividing a pension asset. ABOUT THE AUTHOR Bryan Scant is a senior associate and specialist family solicitor based on the South Coast. He is noted in the Legal 500 rankings as a Key Lawyer within the Family law sector, having been given recognition for private law children matters in particular.
