The Homes (Fitness for Human Habitation) Act 2018 is one of the most important developments in relation to housing conditions and disrepair of the twenty-first century so far. This practical guide is suitable for legal practitioners and other professionals working in the private or social rental sectors, but is also likely to be useful to landlords and tenants trying to navigate their respective rights and obligations under the new law. This book sets out the legislative terrain that existed prior to the Act and provides context about how the Act came to be passed. Thereafter it looks at: what the Act does and how it is likely to be interpreted; what remedies will be available for tenants living in properties that are unfit for habitation and how damages are likely to be quantified; and what steps landlords should take to ensure they comply with the provisions. ABOUT THE AUTHOR Brooke Lyne is a barrister at Landmark Chambers, specialising in property law. Her practice encompasses all areas of real property and landlord & tenant litigation both residential and commercial. She is the Assistant Editor of the Housing Law Encyclopedia and frequently writes journal articles for a number of different publications. Brooke frequently acts for landlords and tenants in disputes involving disrepair and dilapidations. Such experience means she can provide insights into how the Homes (Fitness for Human Habitation) Act 2018 is likely to work in practice.
