Le Conseil d'Etat a de tout temps entretenu une relation singulière avec l'ordre juridique de l'Union européenne et si ce droit a initialement été appréhendé comme une contrainte imposée à l'exercice de sa fonction juridictionnelle, il est progressivement devenu le terreau de son enrichissement. Originellement réticent à se conformer aux exigences mises à sa charge, le Conseil d'Etat a progressivement su se départir des contraintes juridiques et axiologiques qui bridaient son concours à la garantie de l'efficacité du droit de l'Union et il a su tirer les avantages de sa fonction européenne pour non seulement redéfinir ses relations avec les pouvoirs exécutif et législatif, mais également pour revaloriser le pouvoir normatif de sa jurisprudence. L'exercice par le Conseil d'Etat de son office de juge de droit commun l'a alors conduit à s'inscrire dans un espace européen partagé, à la constitution duquel il participe, et qui se révèle être un lieu de comparaison et le creuset de l'élaboration d'un droit public commun. Ces évolutions n'aboutissent pourtant nullement à la dilution de la singularité de la fonction juridictionnelle du Conseil d'Etat qui, dans l'exercice mime de son office de juge de droit commun du droit de l'Union, entend préserver une spécificité irréductible.
